Terms of Service

These Terms of Service ("Terms") govern your use of https://cutgo.eu and the CutGo service ("Service"). The Service is operated by EXISTÊNCIA ELEGANTE UNIPESSOAL LDA, registered at Rua António Aleixo, nº 240, 2865-609 Fernão Ferro, Portugal under NIPC 517149400. By using the Service you agree to these Terms.

1. The service

CutGo is a web application that (a) helps users arrange rectangular parts on sheet material to minimise waste ("cutting optimizer"), and (b) connects users with independent cutting contractors who offer cutting, edgebanding, and related services ("marketplace").

CutGo is not a party to the cutting contract between a user and a contractor. Any agreement for cutting, materials, delivery, payment, and related services is concluded directly between the user and the contractor.

2. Accounts

• To place orders or register as a contractor you must create an account. You are responsible for the accuracy of the information you provide and for keeping your credentials confidential.
• You must be at least 16 years old (or the minimum age of digital consent in your country) to create an account.
• You may delete your account at any time by emailing support@cutgo.eu.

3. Acceptable use

You agree not to:

• use the Service for any unlawful purpose;
• submit false, misleading, or fraudulent information;
• attempt to gain unauthorised access to accounts, systems, or data;
• interfere with the operation of the Service, including sending automated requests that put an unreasonable load on our infrastructure;
• copy, reproduce, or redistribute substantial parts of the Service without our prior written consent;
• upload content that is unlawful, defamatory, infringes intellectual-property rights, or violates the privacy of others.

4. Orders placed through the marketplace

• Prices, materials, lead times, and other information displayed on contractor profiles are provided by the respective contractors. CutGo does not verify this information and makes no warranty as to its accuracy or availability.
• When you place an order, the contractor receives your contact details and the cutting plan. The contractor may accept, propose changes, or decline the order.
• Payment and delivery terms are agreed directly between the user and the contractor. CutGo currently does not process payments on behalf of contractors.
• Complaints about cutting quality, delivery, or refunds must be directed to the contractor in the first instance. We may assist in mediating disputes but assume no obligation to do so.

5. Contractor obligations

If you register as a contractor, you additionally agree that:

• you have the legal right and required authorisations to provide cutting services in your jurisdiction;
• the information you publish (prices, materials, photos, working hours) is accurate and kept up to date;
• you will handle personal data of clients in accordance with applicable data-protection law;
• you will respond to incoming orders in a reasonable time and communicate openly about availability and lead times.

6. Fees

Use of the cutting optimizer is currently free for clients. Cutting services are priced by contractors and paid directly to them. We reserve the right to introduce fees in the future with reasonable notice.

7. Intellectual property

The software, design, trademarks, and content published by us on the Service are owned by EXISTÊNCIA ELEGANTE UNIPESSOAL LDA or our licensors. Content uploaded by users (for example contractor photos, cutting plans) remains the property of the respective user; by uploading such content, you grant us a non-exclusive, worldwide, royalty-free licence to store, display, and process it for the purpose of operating the Service.

8. Disclaimers

The Service is provided on an "as is" and "as available" basis. To the extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Cutting plans generated by the optimizer are guidance only — final cutting decisions and responsibility for the physical cut rest with the user and the contractor performing the work.

9. Limitation of liability

To the maximum extent permitted by law, EXISTÊNCIA ELEGANTE UNIPESSOAL LDA will not be liable for indirect, incidental, special, consequential, or punitive damages, loss of profits, loss of data, or loss of goodwill arising from your use of the Service. Our total aggregate liability in connection with the Service is limited to EUR 100 or the total fees you paid to us in the twelve months preceding the claim, whichever is higher. Nothing in these Terms limits liability that cannot be limited or excluded under applicable law.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you materially breach these Terms, create risk or legal exposure for us, or if we are required to do so by law. Where reasonable, we will notify you before doing so.

11. Changes to these Terms

We may modify these Terms from time to time. The current version is always available at https://cutgo.eu/legal/terms. If we make material changes, we will notify registered users by email or a prominent notice on the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

12. Governing law and jurisdiction

These Terms are governed by the laws of Portugal, excluding its conflict-of-laws rules. Mandatory consumer-protection laws of your country of residence remain unaffected. Disputes shall be resolved by the competent courts of Portugal, unless mandatory law provides otherwise.
